Description

Opting in to the recast EU Reception Conditions Directive puts accommodation and reception conditions for people seeking asylum in to law for the first time.

This training, building on the conference held by the IRC on the Directive in March, aims to give practitioners an overview of the Statutory Instrument that implements the Directive and the tools with which to support and advise their clients.

The training will be led by Patricia Brazil BL who will be supported by members of staff of the IRC.

Subjects covered will include:

  • Information - What information should your client receive and in what format?

  • Labour market access - What vocational training a person who has permission to work is entitled to; in what circumstances can permission be withdrawn or terminated; the reduction of the DP allowance and requirement to pay a contribution if living in DP and employed; overcoming problems relating to proving permission to work to employers.

  • Withdrawal of reception conditions and lack of bed space within DP as a reason for refusal - The appeals process including appeal to the IPAT; entitlement to legal aid entitlement; guidance on when your client is refused access to Direct Provision on the grounds of lack of bed space.

  • The House Rules - what effect and weight do they have.

  • The vulnerability assessment - who is meant to do it and when and what does it mean to be assessed as vulnerable.

  • Education and health - any changes in the provision of health and education support are required.

  • Detention – any changes in relation to detention.

  • Differences between the Directive and the Statutory Instrument RCD - what is the consequence of a provision of the Directive not being contained in the Statutory Instrument.

A small fee of €10.00 will be charged to subsidise the training. This can be waived for unwaged or people in the asylum system.
